We respect your privacy and are committed to protecting your Personal Information. This Privacy Policy explains what information we collect when you use our Products, how we use that information, how we share it, and the choices and rights you have regarding your information.

We design our Products with security and privacy in mind. We are not in the business of selling our customers’ Personal Information for monetary compensation. We aim to be clear about what we collect and how we use it, and we will seek your consent where required by applicable law.

By using our Products, you acknowledge that you have read this Privacy Policy. Where required by applicable law, including the General Data Protection Regulation (“GDPR”), we will request your consent before collecting or using certain types of information.

Our Role

In most circumstances, Boundless Devices, Inc. acts as the “data controller” under applicable data protection laws, including the GDPR, meaning we determine the purposes and means of processing Personal Information.

In limited situations — such as where Products are provided through an internet service provider or similar service partner — we may process certain information on behalf of that partner in accordance with contractual arrangements.

Relationship with Distributors and Retailers

Our Products may be sold through authorized distributors, retailers, or resellers. These entities are independent businesses and may collect Personal Information directly from you when you purchase a product. Their privacy practices are governed by their own privacy policies.

This Privacy Policy applies to Personal Information collected by Moto Home Networking when you register an account, use the MotoSync+ App, connect a device to our services, access our websites, contact customer support, or otherwise interact directly with us.

What Information We Collect

“Personal Information” means information that identifies or relates to an identifiable individual.

We collect information in several ways.

Information You Provide to Us

When you create an account, purchase a device, register a product, contact customer support, or submit feedback, we may collect information such as your name, email address, telephone number, billing and shipping details, payment information, and account login credentials. If you contact us for support, we collect the information you provide in your communications so we can assist you. If you submit a testimonial, we will obtain your consent before publishing your full name.

Information Collected Through Our Products

Because our Products operate networking equipment, we also collect certain technical and network-related information necessary for the Products to function properly.

This may include network performance information such as internet speeds, bandwidth usage, ISP information, and device performance data like temperature, memory, and processor usage. We may collect device configuration details including MAC addresses, IP addresses, firmware versions, Wi-Fi channel usage, device hostnames, and information about the types of devices connected to your network. This information allows us to operate your network, provide troubleshooting support, detect security issues, improve performance, and enhance product reliability.

When you use the MotoSync+ App or visit our website, we may collect information about your device and how you interact with our Products, including device identifiers, operating system version, crash reports, engagement information, browser type, and website usage data. We only track browsing activity within your network if you enable browsing history features in the MotoSync+ App.

Information from Other Sources

In some cases, we may receive limited information from third parties, such as payment processors, linked accounts, or service partners that provide devices as part of their services.

How We Use Your Information

We use Personal Information to provide, operate, secure, and improve our Products. This includes creating and managing accounts, processing transactions, delivering customer support, sending service-related communications (such as firmware updates or security alerts), monitoring network performance, improving product functionality, and protecting against fraud or security threats.

We may also use your information to send marketing communications about our Products and related services. You can opt out of marketing communications at any time, although we may still send important service-related notices.

If you are located in the European Economic Area (“EEA”) or the United Kingdom (“UK”), we process your Personal Information only when we have a valid legal basis. This may include when processing is necessary to perform a contract with you, comply with legal obligations, pursue legitimate interests such as improving network security and reliability, or where you have provided consent.

We may generate aggregated or de-identified information from Personal Information. This information does not identify you and cannot reasonably be used to identify you. We use aggregated information to improve network performance, strengthen security, and enhance our Products.

How We Share Information

We do not sell your Personal Information for monetary compensation.

We share Personal Information only as described in this Privacy Policy and only when necessary to operate our business, provide our Products, comply with legal obligations, or protect our rights.

We share Personal Information with trusted service providers who perform services on our behalf. These may include companies that process payments, provide cloud hosting and data storage, support product analytics, deliver customer support tools, manage marketing communications, conduct product testing, or help us improve network performance. These service providers are contractually required to process Personal Information only according to our instructions and to implement appropriate security and confidentiality safeguards.

If your device was provided through an internet service provider, telecommunications company, property manager, or similar partner (“Service Partner”), certain product and network information may be shared with that Service Partner, or with vendors acting on their behalf, for the limited purpose of enabling them to provide support, device management, broadband services, or related enhancements. This may include information such as device model, firmware version, WAN IP address, or network configuration details. If you no longer receive services from a Service Partner and wish to disable sharing related to that relationship, you may contact customer support.

If you connect a device to a network managed by another person — such as a Network Owner or Network Administrator — certain device-related information, including device type, MAC address, hostname, and connection status, may be visible to that Network Owner or Administrator so they can manage the network and connected devices. We are not responsible for how Network Owners or Administrators use information visible to them through network management tools.

We may also share Personal Information with our affiliates, provided they follow privacy practices at least as protective as those described in this Privacy Policy.

In addition, we may disclose Personal Information when we believe in good faith that disclosure is necessary to comply with applicable law, respond to lawful requests from public authorities, enforce our agreements, investigate potential violations, prevent fraud or security issues, or protect the rights, safety, and property of Moto, our users, or others.

We may publish feedback or testimonials you provide, but we will obtain your consent before displaying your full name. If you post comments in public areas of our website, such as blogs or forums, any information you choose to share in those spaces may be visible to others.

Corporate Restructuring and Business Transfers

As our business grows and evolves, we may buy, sell, merge with, or reorganize businesses or assets. In the event of a merger, acquisition, reorganization, sale of assets, bankruptcy, or similar transaction, Personal Information may be transferred as part of the transaction. If this occurs, the transferred Personal Information will remain subject to the commitments made in this Privacy Policy (unless you consent otherwise or as permitted by law). We will take reasonable steps to ensure that any successor entity honors the protections described in this Policy.

Your Privacy Choices and Rights

We believe you should have meaningful control over your Personal Information.

You may access, update, or correct certain account information directly through the MotoSync+ App or by logging into your account. You may also contact us to request access to the Personal Information we maintain about you, request correction of inaccurate information, or request deletion of your Personal Information.

If you choose not to provide certain Personal Information, some features of the Products may not function properly. For example, if you delete your account as a Network Owner, your devices may reset and you may need to create a new account to continue managing your network.

You may opt out of receiving promotional emails at any time by clicking the unsubscribe link in our marketing emails or by adjusting your communication preferences in the MotoSync+ App. Even if you opt out of marketing communications, we may still send important service-related messages, such as security alerts, firmware updates, billing notices, or changes to our terms.

You may uninstall the MotoSync+ App at any time using the standard uninstall process on your device. You may also disconnect or power off Moto devices to stop the transmission of network performance data, though this may limit functionality of the Products.

If you are located in the European Economic Area or United Kingdom, you may have additional rights under applicable data protection laws. These may include the right to request access to your Personal Information, request correction or deletion, request restriction of processing, object to certain processing activities, request portability of your information in a structured format, withdraw consent where processing is based on consent, and lodge a complaint with your local data protection authority.

If you are a California resident, you may have rights under applicable state privacy laws, including the right to request access to categories and specific pieces of Personal Information we have collected about you, request correction of inaccurate information, request deletion of Personal Information (subject to certain exceptions), and opt out of certain data sharing activities as defined by California law. We will not discriminate against you for exercising your privacy rights.

To exercise your rights, you may contact us through our website or customer support channels. We may need to verify your identity before fulfilling certain requests.

For individuals located in the European Economic Area or the United Kingdom, we implement appropriate safeguards for international transfers of Personal Information as required by applicable law, including reliance on adequacy decisions or Standard Contractual Clauses.
